The age discrimination law discriminates against staff of pensionable age by allowing their removal from pension schemes, death in service benefit and similar insurance cover. Loss of these benefits can be substantial. The States should instead be promoting the retention of such staff.

The background to the above relates to the Age Discrimination Regulations that came into force in September 2016 and, in particular, Articles 33 and 34 of the Law. As it currently stands, the Law has no teeth as it permits the discrimination of employees who continue to work after reaching pensionable age by permitting their removal from pension schemes, death in service benefit and other similar insurance cover.
