Closed petition Change the law so people can divorce without spouse consent after 1yr separated
Presently under Jersey law you can divorce after one year being separated if you have consent from your spouse, otherwise you are forced to wait 2 years to divorce without consent. This law is outdated and in some other jurisdictions you can ‘no-fault’ divorce sooner.

If a person has decided they don't want to stay married to their spouse for a valid reason, and this could include unreasonable behaviour, emotional abuse etc it is unfair they should have to wait 2 years for consent from their spouse, and may not be able to afford lawyer fees. They want to move on with their life, but can't do this if having to wait for the full 2 years. This needs reviewing.
