The Legal System can and should be overhauled and modernised where possible. The Legal System is no place for tradition where lives are adversely impacted and sometimes ruined by a lack of clarity and consistency in rulings and the common law followed. Often the lawyers themselves are advising that the system is unpredictable and effectively going to Court is akin to gambling. There is too much acceptance that the Jersey public must accept certain downgrades on matters such as conflict of interest, for example, which leads to dangerous and unfair practices.
